By accessing or using this website, you acknowledge that you have read and agree to these Terms. If you do not agree, please discontinue use of the website.
IMPORTANT NOTICE
Submitting a website form does not create a reservation, tenancy, lease, occupancy agreement or guarantee of housing. Housing remains subject to availability, qualification, written approval, executed agreements and required payments.
1. ACCEPTANCE OF THESE TERMS
These Terms apply to all visitors, prospective clients, occupants, property owners, company representatives, insurance or relocation representatives and other users of this website.
Your continued use of the website following an update to these Terms constitutes acceptance of the revised Terms.
2. WEBSITE PURPOSE
This website provides general information about BLC’s professionally furnished housing services for stays of 30 days or longer in Birmingham, Alabama and surrounding areas.
The website allows visitors to:
Submit housing inquiries;
Submit property-owner inquiries;
Learn about BLC’s services;
Contact BLC;
Access BLC’s external client portal after receiving authorization; and
Review BLC’s policies and general business information.
Website content is provided for informational and inquiry purposes. Nothing on this website constitutes legal, tax, financial, insurance or real-estate advice.
3. HOUSING INQUIRIES AND AVAILABILITY
Submitting a housing inquiry only provides BLC with information needed to evaluate a potential housing request.
A submitted inquiry does not:
Guarantee that housing is available;
Guarantee that BLC will accept or fulfill the request;
Reserve or hold a residence;
Create a landlord-tenant relationship;
Create an occupancy right;
Create a contract or payment obligation; or
Guarantee approval following screening or verification.
Housing availability may change at any time. Any housing options, pricing, locations, amenities, photographs or descriptions presented to a prospective client remain subject to verification and written confirmation.
BLC may request additional information before determining whether it can fulfill a housing request. Qualification, screening, identity verification, payment requirements and supporting documentation may vary depending on whether the placement is self-paid, employer-paid, insurance-funded, relocation-sponsored or arranged through another organization.
BLC evaluates housing requests and prospective occupants in accordance with applicable fair-housing and anti-discrimination requirements.
4. NO RESERVATION OR AGREEMENT CREATED
No housing reservation, lease, occupancy agreement or other binding housing arrangement exists unless all required parties have:
Received written approval from BLC;
Completed all required verification or screening;
Accepted the applicable pricing and payment requirements;
Signed the required written agreements; and
Paid all required amounts by the stated deadlines.
Website content, emails, telephone conversations, form submissions and preliminary housing options do not replace a fully executed written agreement.
If any website content conflicts with a signed agreement, the signed agreement controls.
5. PROPERTY-OWNER INQUIRIES
Submitting a property-owner inquiry does not create a lease, partnership, agency relationship, property-management agreement or obligation between BLC and the property owner.
BLC evaluates each property individually. Factors may include location, condition, property type, lease terms, permitted occupancy model, insurance compatibility, ownership authority, community rules and expected housing demand.
BLC is not obligated to accept, lease or market any property submitted through the website. A property relationship exists only after all required reviews are completed and the parties sign an applicable written agreement.
Unless expressly established in a signed agreement, BLC does not act as the property owner’s real-estate broker, property manager, legal representative or agent.
6. CLIENT PORTAL AND THIRD-PARTY SERVICES
BLC may provide approved clients and occupants with access to an external client portal operated through TenantCloud or another authorized service provider.
Portal access is available by invitation only. A website visitor cannot create an approved BLC client relationship merely by accessing a third-party login page.
The client portal may be used to:
Review charges and balances;
Make authorized payments;
Access payment history or receipts;
Review or sign documents;
Receive communications; and
Use other features enabled for an active placement.
TenantCloud, Stripe and other third-party platforms operate under their own terms, privacy policies, security practices and availability standards. BLC does not control the continuous availability or independent operation of those platforms.
Users are responsible for protecting their login credentials and promptly notifying BLC through the Contact Us form if they suspect unauthorized access connected to a BLC placement.
7. PAYMENTS
BLC does not collect or store full payment-card numbers or bank-account credentials through its public website forms.
Authorized payments are processed through BLC’s designated third-party payment platform. Additional payment terms, due dates, deposits, fees, refunds and cancellation conditions will be governed by the applicable invoice, payment authorization and signed housing agreement.
Submitting a housing inquiry does not authorize BLC to charge the person submitting the form.
8. SCREENING AND VERIFICATION
When screening or verification is required, BLC may use an authorized third-party provider.
Any background, identity, credit or tenant-screening process will be subject to separate disclosures, authorizations and applicable screening criteria. Submitting a general website inquiry does not by itself authorize BLC or a third party to obtain a consumer report.
Company-paid, insurance-funded and relocation-sponsored placements may require different documentation than self-paid placements. BLC may separately evaluate the responsible payer and the proposed occupant.
9. ACCEPTABLE USE
You agree not to use this website to:
Submit false, misleading or fraudulent information;
Impersonate another person or organization;
Attempt to obtain unauthorized access to BLC systems or accounts;
Interfere with the operation or security of the website;
Upload malicious code, automated scripts or harmful content;
Collect information about other users without authorization;
Use BLC’s name, branding or materials without permission;
Submit unlawful, threatening, discriminatory or abusive content; or
Use the website for any purpose prohibited by applicable law.
BLC may restrict or block access when reasonably necessary to protect the website, BLC’s operations or other users.
10. ACCURACY OF INFORMATION
BLC works to keep website information accurate and current. However, website content may occasionally contain typographical errors, outdated information or technical inaccuracies.
Housing availability, pricing, amenities, property features, policies and service capabilities may change. Information should be independently confirmed before a visitor relies on it for a housing, financial or business decision.
BLC may correct, update or remove website content without prior notice.
11. PHOTOGRAPHS AND PROPERTY REPRESENTATIONS
Photographs and visual materials may represent the general type, style or quality of housing BLC seeks to provide. Unless a particular residence is expressly identified and confirmed in writing, an image does not guarantee the availability of that residence or an identical floor plan, furnishing package, amenity, view or location.
Final property details will be provided during the applicable housing-selection and agreement process.
12. INTELLECTUAL PROPERTY
The website’s original text, graphics, branding, logos, layout and other BLC-created materials are owned by or licensed to Birchwood Living Co., LLC and are protected by applicable intellectual-property laws.
You may view and use website content for personal or legitimate business inquiry purposes. You may not copy, reproduce, modify, publish, sell, distribute or commercially exploit BLC content without prior written permission.
Third-party names, photographs, trademarks and platform references remain the property of their respective owners.
13. PRIVACY
Your use of the website is also governed by BLC’s Privacy Policy.
The Privacy Policy explains what information BLC collects, how the information is used, when it may be shared and the choices available to website visitors.
Submitting information through a BLC form constitutes your request for BLC to review the submission and respond using the contact information you provide. It does not automatically enroll you in unrelated marketing communications.
14. COMMUNICATIONS
When you submit a form, you authorize BLC to contact you regarding that inquiry through the email address or telephone number you provide.
You are responsible for providing accurate contact information and for notifying BLC if that information changes.

External links are provided for convenience. BLC does not control and is not responsible for third-party content, security, accessibility, privacy practices or availability. Accessing an external website is subject to that website’s applicable terms and policies.
16. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the website and its general informational content are provided on an “as is” and “as available” basis.
BLC does not guarantee that:
The website will always operate without interruption;
All website content will be error-free;
A submitted inquiry will receive approval;
Housing will be available in a requested location or timeframe; or
A third-party platform will remain continuously available.
Nothing in this section limits any warranty, duty or right that cannot lawfully be excluded.
17. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, BLC will not be liable for indirect, incidental, special or consequential damages arising solely from use of, or inability to use, this public website.
This limitation does not apply to obligations established under a separate signed agreement, liability that cannot legally be limited or conduct for which limitation is prohibited by law.
Users remain responsible for independently verifying time-sensitive housing, payment and property information before acting on it.
18. INDEMNIFICATION
To the extent permitted by law, you agree to be responsible for losses, claims or expenses arising from your unlawful use of the website, your intentional submission of false or fraudulent information or your violation of another party’s rights.
This section does not create responsibility for conduct or losses caused by BLC.
19. GOVERNING LAW
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles.
Unless applicable law requires otherwise or the parties agree differently in a signed contract, disputes concerning use of this public website will be addressed in a court of competent jurisdiction serving Jefferson County, Alabama.
20. SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect. The affected provision will be interpreted or modified only to the minimum extent necessary to make it enforceable where permitted by law.
21. NO WAIVER
BLC’s failure to enforce a provision of these Terms does not waive its right to enforce that provision or any other provision later.
22. CHANGES TO THESE TERMS
BLC may update these Terms to reflect legal, operational, security or service changes.
The “Last Updated” date at the top of this page identifies the most recent revision. Updated Terms become effective when posted unless a later effective date is stated.
